Hampden County Divorce Fees and Costs

Hampden County uses the same fee schedule as every other Probate and Family Court in Massachusetts. The Trial Court sets these fees statewide, so the cost is the same whether you file in Springfield or any other county. Knowing the fees up front helps you plan.

A joint petition for divorce under M.G.L. c. 208, § 1A costs $215. This is the most common type of no-fault divorce where both spouses agree. A complaint for divorce under M.G.L. c. 208, § 1B costs $280. That applies when one spouse files alone. On top of the filing fee, there is a $15 surcharge. A summons costs $5 and a citation is $15. Service by a constable or sheriff runs about $50 to $75 more.

Getting copies of Hampden County divorce records also has set fees. A Certificate of Divorce Absolute costs $20. A certified copy of the Judgment of Divorce Nisi is $20. The separation agreement runs $20 for the first page plus $0.05 per extra page. Attested copies are $2.50 per page. Filing for Divorce in Hampden County

First, you must meet the residency rule. Under M.G.L. c. 208, § 5, if the cause for divorce happened outside Massachusetts, at least one spouse must have lived in the state for one year before filing.
