If you cannot afford the fees, you can ask for a fee waiver. File an Affidavit of Indigency with the court. A judge will review it and decide if you qualify for reduced or waived fees.
Filing for Divorce in Hampden County
Filing for divorce in Hampden County follows Massachusetts state law. The main statute is M.G.L. Chapter 208, which covers all aspects of divorce in the state. Every step in the process creates documents that become part of your case file at the Probate and Family Court in Springfield.
First, you must meet the residency rule. Under M.G.L. c. 208, § 5, if the cause for divorce happened outside Massachusetts, at least one spouse must have lived in the state for one year before filing. If the grounds came up in Massachusetts, there is no minimum wait. You file at Hampden Probate and Family Court if you or your spouse lives in Hampden County, or if it is the county where you last lived together as a married couple.
Massachusetts allows both fault and no-fault divorces. No-fault is by far the most common path in Hampden County. Under § 1A, both spouses file a joint petition along with a signed separation agreement. Under § 1B, one spouse files alone. Fault grounds under M.G.L. c. 208, § 1 include adultery, desertion, cruel treatment, and habitual intoxication.
After the judge enters a judgment nisi, the divorce is not yet final. Joint petition cases under § 1A have a 120-day nisi period. Cases filed under § 1B have a 90-day wait. Only after that waiting period does the divorce become absolute. The Certificate of Divorce Absolute is the document that proves your marriage has ended. You can request it from the Register of Probate at the Springfield courthouse.

Financial statements show each spouse's income and debts. All of these sit in the court file and are available for review.
The judgment of divorce nisi is the main record most people need from Hampden County. This is the order that ends the marriage once the nisi period passes. It spells out the terms: who gets what property, custody of children, the visitation plan, and any support amounts. Under M.G.L. c. 208, § 34, the court looks at many factors when splitting property, and those details appear in the record. Things like the length of the marriage, each spouse's income, health, and contributions all play a role.
