Divorce Process for Cambridge Residents

Filing for divorce as a Cambridge resident means going to the Middlesex South court in Woburn. Under M.G.L. c. 208, § 4, you file in the county where the spouses last lived together. If neither lives there now, you can file in the county where either spouse currently lives. For Cambridge, that means Middlesex County.

The no-fault path under § 1A is the most used. Both sides file together and bring a signed agreement. The court sets a hearing. After the judge signs off, the nisi period is 120 days. Under § 1B, one spouse files alone and the other gets served. The nisi period for that is 90 days. Fault divorces under § 1 are less common.

Cambridge residents can also file online through eFileMA. The system charges a small processing fee on top of court costs. This can save you a trip to Woburn for the initial filing.

Note: A Cambridge divorce is not final until the nisi waiting period runs out after the judge enters the order.

Cambridge Divorce Record Contents

A Cambridge divorce case file holds the complaint or joint petition, financial statements, and any separation agreement. Cases with children include a parenting plan and child support worksheet. All motions and court orders during the case are also in the file.

The judgment of divorce nisi is the main document. It covers property division, custody, support, and all other terms set by the court. Under M.G.L. c. 208, § 34, the court considers many factors when splitting assets, including each spouse's income, age, and contributions. After the nisi period, the Certificate of Divorce Absolute confirms the end of the marriage. Most records are public, but some financial data and info about minors may be restricted.
